Our opportunity As General Counsel, Construction, you will manage the legal affairs and some of the key business operations of the National Construction business and the Project Design Management function at Mirvac. Your responsibilities will include: Manage the legal services and support requirements of the National Construction business, the Project Design Management (PDM) function, and the Digital Construction Office Managing legal strategy and providing structuring advice for all legal needs for the six operating entities within the Construction business. Advising on the impact of legislation on the Construction business including the D&BP Act, RAB Act, SOP Act and legislation regarding engineered stone. Providing construction legal input into structuring and delivery risk allocation for large mixed-use project or projects requiring delivery of build form including AFLs, government bids and private tenders. Ensuring that any construction documentation with third party principals (eg joint venture entities) reflects the appropriate risk profile. Implementation and maintenance of service agreements between the Construction business and all internal Mirvac entities (e.g. Development entities / SPV’s). Managing the day to day negotiations and amendments to standard Mirvac documentation with third parties (e.g. subcontractors and consultants). Oversee and signoff “additional contract measures” as required for subcontractors. In conjunction with the internal dispute resolution counsel, managing all Construction related disputes with third parties (including post completion issues). Providing day to day legal advice to the Constructions business, including advice on industrial relations and HSE matters. Providing legal training to the Construction business as required (in areas including contracts administration and OHS). Facilitation (in conjunction with Group CoSec) of directors meetings for all active Construction entities. Interface with the project team to pre-empt and find solutions to commercial and contract related issues and disputes. Instruct and manage external law firms. Manage the external and internal corporate compliance issues of the Construction business. Manage the interface of the Construction business with the Group corporate functions such as Internal Audit and Risk, including ICQ (Internal Control Questionnaire) bi-annual reporting. Manage all post completion issues associated with the Construction business. Oversee the central procurement function, including negotiations and drafting of supplier agreements, and oversight of reporting to Group procurement function. Review of limits of authority for the Construction business, including compliance at project level. Your point of difference To be successful you will have a Bachelor of Law degree, extensive post qualification experience and currently operating as a Partner, Special Counsel or Senior Lawyer in the construction sector or in a senior in house role in the construction industry; Demonstrated leadership and people management experience with the ability to work as a business partner supporting project delivery teams and senior management to facilitate and achieve commercial outcomes whilst managing risk; Experience in developing, implementing and communicating processes and systems including legal compliance processes and superior interpersonal, problem solving, technical and analytical skills is critical.
