The Executive Director, Legal Services and General Counsel reports to the Health Ombudsman. As a member of the Executive Leadership Team, you will play a crucial role in ensuring public health and safety and achieving the Office of the Health Ombudsman’s strategic goals and objectives. You will be responsible for leading and managing legal, prosecutorial, (unregistered practitioners) and legislative functions of the organisation, and identifying and addressing legal risks. The position is required to provide expert legal counsel and high level strategic and operational leadership of the legal services division necessary to deliver high-quality legal advice and representation and to work collaboratively with other divisions. The Executive Director, Legal Services and General Counsel will provide expert legal counsel to the Health Ombudsman on the interpretation and application of the Health Ombudsman Act 2013, Health Practitioner Regulation National Law 2009 (Queensland) and other applicable legislation. As ED you will manage the performance of the Division’s team of legal and administrative officers (including Release of Information function). The legal team operates flexibly across the functional areas, allowing for agile responses to shifting priorities and workload demands and works closely with other divisions to identify and minimise legal risks to the OHO by delivering high-quality, independent, and objective legal advice and representation, including in appeals of immediate action decisions and other legal challenges. The ED will also provide expert quality and timely legal services on complex matters across a broad range of legal areas affecting or likely to affect the performance of the Health Ombudsman’s functions. These include statutory interpretation, administrative law, release of information and information privacy, evidence, and employment, health and contract law. This role involves close collaboration with the Director of Proceedings to ensure consistent approaches in the performance of legal functions across the office and works closely with other divisions on cross functional approaches to matters. Given this close working relationship, it is crucial you are cooperative, adaptable, and a composed professional with an engaging personality. In this key position, it is essential you possess high EQ, supporting strong resilience, sound judgment, and critical thinking to effectively manage complex and sensitive issues. You will also play a key role in mentoring and upskilling staff, translating complex legal concepts into accessible guidance for non-legal colleagues. Furthermore, the ED is responsible for providing strategic and operational leadership for the performance of the legal services team, driving a positive workplace culture and supporting staff to achieve their operational and performance targets and to engage effectively in cross functional approaches with other divisions. You will of course bring a deep knowledge and understanding of management of complex litigation or prosecutions involving sensitive matters and risks of harm and previously practiced in a court or tribunal setting. The successful candidate will demonstrate an awareness of emerging issues in health practitioner regulation and practices, particularly considerations for maintaining public confidence in health practitioners and the health system.
