Legal Group Overview The Legal Group provides legal services and support to Comcare to perform these functions and is based in both Canberra and Melbourne. The work of the Legal Group is diverse and varied, and includes: investigation and prosecution support regarding alleged breaches of the Work Health and Safety Act 2011 (WHS Act); legal advice and decision support for Comcare's claims management functions, conducting merits review proceedings in the Administrative Appeals Tribunal (AAT), conducting judicial appeals and providing legal and strategic advice on evidence and risk; legal advice and support for all legislation administered by Comcare, including corporate and governance functions; legal advice and support for all of Comcare's administrative legal functions; developing delegated legislation and support to Comcare's involvement in developing primary legislation; supporting the SRCC and Seacare Authority; and monitoring and managing litigation across the Comcare scheme. Regulatory Legal Team Overview The Regulatory Legal team provides advice and support to Comcare's regulatory activities, including investigations under the WHS Act and criminal prosecutions for alleged contraventions of the WHS Act. The team support the Regulatory Operations Group by: providing advice and guidance on evidence gathering, the issuing of statutory notices and investigation procedures (investigations); assisting with the preparation of briefs of evidence (prosecutions); working closely with the Commonwealth Director of Public Prosecution and the Inspector when a prosecution is commenced; and facilitating continuous improvement projects and identifying trends and capability opportunities for inspectors. The key duties of the position include Primary Responsibilities Manage a varied caseload of complex legal and strategic matters regarding work health and safety law in accordance with required standards, and provide legal advice and support to investigations and prosecutions under the WHS Act, including: delivery of high quality, timely, client focused legal and strategic advice and support; working collaboratively with client areas and other stakeholders to manage issues and risk for Comcare; ensuring work complies with internal and external policies, procedures and guidelines; and contributing to delivery of training, guidance and process improvements to support the Legal Group and client areas to achieve business priorities. Develop and maintain internal and external relationships that manage risk for Comcare, fostering teamwork and collaboration across the organisation, problem solving and conflict resolution. Demonstrate strong verbal and written legal communication skills. Develop and support implementation of business improvements, strategies, frameworks, policies, procedures and guidance, draft reports and/or briefs, update Legal Group reporting documents, contribute to business planning, and formulate recommendations on legal and policy issues. Participate in corporate learning and development activities and continue to develop legal professional knowledge, skills and expertise. Promote workplace safety, equity and diversity and environment practices in the workplace. Mandatory Qualifications and Experience Undergraduate degree in law. Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory (3 years or more post admission experience is desirable). Current Practising Certificate or ability to obtain one within three months.
