Provide high quality legal support and advice related to procurement, tendering, compliance and risk-management to our local government Client. Position : Legal Counsel Start : ASAP Duration : 6 months with possible extension Hours : 35 hours per week Salary : $65.19 per hour plus superannuation Location : Wakeley NSW Primary Purpose of the Position The primary role of the Legal Counsel is to provide legal services in compliance matters and transactional (commercial contract) matters, with a secondary role in contract management and dispute resolution. The Legal Counsel will instruct external solicitors to provide these services when appropriate, particularly in the event of litigation. The Legal Counsel will work most closely with the Procurement and Governance divisions but will assist staff across all business units while working with the specific requirements of the relevant business unit. Key Accountabilities/Responsibilities The key responsibilities and essential criteria for this role include but are not limited to: Conduct legal research, provide legal information, draft legal documents and correspondence such as emails and letter preparation. Support and guide procurement and other internal stakeholders through approaches to market, particularly direct negotiations, as required. Review standards, proposed supplier contracts, requested amendments and departures and making recommendations for changes to address legal and commercial risk and ensure fitness for the Client’s purposes. Identify, manage and guide staff through issues arising from actual or perceived non-compliance. Investigate complex legal issues arising in areas such as procurement, consumer law, planning, waste and environmental protection, privacy and information protection, reporting and disclosure of information, roads, construction, abandoned property, companion animals and modern slavery, giving practical guidance to staff in response to such issues. Work collaboratively with colleagues of various specialisations to pursue their desired outcomes while ensuring effective legal and commercial risk management, legal compliance, and sound governance. Essential Criteria Be admitted as a lawyer in the state of New South Wales holding a current New South Wales practising certificate or being entitled to hold a New South Wales practising certificate authorising the holder to practice as a solicitor. At least two years of experience in legal practice in a transactional or legal compliance role. Have the ability to anticipate and manage problems in ambiguous situations, develop appropriate solutions based on thorough evaluation and interpretation, and justify conclusions with clear reasoning. Be able to negotiate effectively, identifying and pursuing the Client’s real interests while allocating legal and commercial risk in line with the Client’s risk appetite. Work within short timeframes without compromising accuracy and sound judgment in all matters, taking into account the Client’s strategic priorities. Must have own vehicle and be willing to work on-site 5 days per week.
