D’Arcy Weil is representing a leading organisation in the renewable energy sector, seeking an experienced Senior Legal Counsel to support their Battery Energy Storage Systems (BESS) initiatives. This role is critical to providing expert legal guidance on the development, implementation, and operation of BESS projects across Australia, ensuring compliance and mitigating risks in a rapidly growing industry. As Senior Legal Counsel, you will work closely with cross-functional teams, including project development, engineering, finance, and regulatory affairs, to advise on all legal aspects of BESS projects. Your expertise will be instrumental in navigating complex regulatory environments, drafting and negotiating contracts, and managing legal risks associated with large-scale energy storage systems. Key Responsibilities Provide comprehensive legal advice on the development, construction, and operation of BESS projects, including project structuring, financing, and regulatory compliance. Draft, review, and negotiate a wide range of contracts, including EPC agreements, O&M agreements, supply contracts, and grid connection agreements. Ensure compliance with Australian energy regulations, market rules, and environmental laws, advising on potential risks and mitigation strategies. Lead legal due diligence for project acquisitions, joint ventures, and other strategic transactions related to BESS. Manage relationships with external legal counsel, ensuring the effective resolution of disputes, claims, and litigation. Collaborate with internal teams to develop and implement legal strategies that align with business objectives and regulatory requirements. Support project financing efforts, including the negotiation of loan agreements, security documentation, and other financing-related legal documents. Monitor and interpret changes in legislation, regulations, and industry standards, advising the business on implications and necessary actions. Support risk management efforts, including the identification, assessment, and mitigation of legal risks associated with BESS projects. Participate in industry forums, working groups, and regulatory consultations to represent the organisation’s interests and advocate for favourable outcomes. Provide strategic advice on the legal aspects of new business models, market entry strategies, and other growth initiatives related to BESS. Qualifications and Experience Bachelor’s degree in Law; a Master’s degree or specialised qualifications in energy law or project management is highly desirable. Admitted as a legal practitioner in Australia, with a current practising certificate. Minimum of 7-10 years of post-qualification experience, with a strong focus on energy, infrastructure, or project finance law. In-depth knowledge of Australian energy markets, regulatory frameworks, and environmental laws. Proven experience in drafting and negotiating complex contracts, particularly in relation to large-scale infrastructure or energy projects. Strong understanding of the legal issues surrounding renewable energy, grid connections, and energy storage systems. Excellent negotiation, communication, and interpersonal skills, with the ability to manage relationships with a wide range of stakeholders. Demonstrated ability to manage multiple projects and priorities in a fast-paced environment. High level of attention to detail, with a commitment to delivering high-quality legal work.
